Terms and Conditions
§ 1 Scope
These General Terms and Conditions apply exclusively to the business relationship between Malak Bekleidung (hereinafter "Provider") and the customer in the version valid at the time of the order.
§ 2 Contracting Party

§ 3 Conclusion of Contract
(1) The presentation of products in the online shop does not constitute a legally binding offer, but an invitation to place an order.
(2) By clicking the "Buy now" button, the customer places a binding order. The order can only be placed if the customer accepts these terms and conditions.
(3) The Provider sends an automatic order confirmation by email. This confirmation does not yet constitute acceptance of the offer. The contract is concluded only upon dispatch confirmation or delivery of the goods.
§ 4 Prices and Shipping Costs
(1) All prices in the online shop include the applicable statutory value-added tax (currently 19%).
(2) Shipping costs are clearly communicated before placing the order. Within Germany, shipping is via DHL. Free shipping within Germany for orders over €100.00.
(3) For deliveries to other EU countries, separate shipping costs apply, which are transparently displayed during the ordering process.
§ 5 Delivery
(1) Delivery is made to the delivery address specified by the customer.
(2) Delivery within Germany usually takes 2–5 business days after receipt of payment. Deliveries to other EU countries may take longer.
(3) If a product cannot be delivered, the Provider will inform the customer immediately. Payments already made will be refunded promptly.
§ 6 Payment Methods
(1) The customer can choose from the following payment methods:
- Credit card (Visa, Mastercard) via Stripe
- PayPal
- Klarna
- SumUp
- Bank transfer (prepayment)
(2) For bank transfer payments, the purchase price must be transferred within the deadline stated in the order confirmation. Goods will only be shipped after receipt of payment.
(3) When paying via Klarna, PayPal, or Stripe, the respective terms of the payment service provider also apply.
§ 7 Retention of Title
The goods remain the property of the Provider until full payment has been made.
§ 8 Warranty
(1) Statutory warranty rights apply.
(2) The customer is asked to inspect the goods upon delivery for obvious defects and to report these to the Provider immediately.
(3) The warranty period is two years from delivery of the goods.
§ 9 Liability
(1) The Provider is fully liable for damages resulting from injury to life, body, or health, as well as for damages caused intentionally or through gross negligence.
(2) Otherwise, liability is limited to foreseeable, contract-typical damage in the event of a breach of essential contractual obligations.
§ 10 Right of Withdrawal
Consumers have a statutory right of withdrawal. The full withdrawal policy can be found under "Withdrawal Policy".
§ 11 Data Protection
The Provider collects and processes personal data only in accordance with applicable data protection regulations. Details can be found in our Privacy Policy.
§ 12 Online Dispute Resolution
(1) The European Commission provides a platform for online dispute resolution (ODR): https://ec.europa.eu/consumers/odr/
(2) We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.
§ 13 Final Provisions
(1) The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers, this choice of law only applies insofar as the protection granted by mandatory provisions of the law of the consumer's country of residence is not withdrawn.
(2) Should individual provisions of these Terms be invalid, the validity of the contract as a whole shall remain unaffected.
